Terms of Service
Please read these Terms carefully. Section 17 contains a binding arbitration agreement and a class action waiver that affect how disputes are resolved. You may opt out of arbitration as described in Section 17.6.
1. Agreement to these Terms
These Terms of Service (the "Terms") form a legally binding agreement between you and Angelware, the company behind COSMIC ("COSMIC", "we", "us" or "our") governing your access to and use of the website at cosmic.audio, the COSMIC analysis service, the COSMIC application programming interface (the "API"), and any related software, content and services (together, the "Service").
By accessing or using the Service, submitting audio or a link for analysis, creating an account, generating an API key or purchasing a plan, you acknowledge that you have read, understood and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree, you must not access or use the Service.
If you use the Service on behalf of a company or other legal entity, you represent and warrant that you have authority to bind that entity to these Terms, and "you" refers to that entity.
2. Eligibility
You must be at least 13 years of age, or any higher minimum age required to consent to the processing of personal data in your country of residence, to use the Service. If you are under the age of majority where you live, you may use the Service only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms. You must be of the age of majority to purchase a plan. You may not use the Service if you are barred from doing so under applicable law, including sanctions and export control laws.
3. The Service
COSMIC analyses audio you submit and reports an automated, statistical assessment of whether the audio shows characteristics associated with audio produced by artificial intelligence, together with related evidence such as embedded metadata. The Service may be offered with or without an account, subject to usage allowances, rate limits and plan limits that we set and may change.
We may add, change, suspend or discontinue any part of the Service at any time, including the models, thresholds, supported formats, supported link sources, allowances and features, with or without notice. We are not liable to you or any third party for any such change, suspension or discontinuance, except as required by law or as expressly stated in a paid plan.
4. Nature of results; no reliance; published figures
In these Terms, "Results" means anything the Service reports or shows, including scores, labels, probabilities, confidence indicators, charts, tables, evidence, metadata readings, reports, API responses and any evaluation or accuracy figures we publish.
Results are probabilistic estimates produced by automated systems. They are not proof, certification, legal opinion, expert testimony or a finding of fact about how any recording was created, who created it, or whether any person acted improperly. Detection models can and do make errors, including false positives (reporting that human-made audio shows AI characteristics) and false negatives. Accuracy figures we publish describe performance on specific test sets under specific conditions and are not a guarantee of performance on any particular recording.
You agree that you will not use any result as the sole basis for any decision that has legal, financial, professional, reputational or similarly significant effects on any person, including decisions concerning publication, distribution, payment, royalties, employment, academic standing, contest eligibility, account suspension or accusations of misconduct. You are solely responsible for any decision you make, and any action you take, based on a result, and for independently verifying any result before relying on it.
Where a Result names a generator, such as "Likely made with" or "Possibly made with", it names the one the recording most resembles. That is a statistical estimate, not a finding about which tool, account or person made the recording.
Results are not statements of fact. No artificial intelligence system or classifier, including COSMIC, is error-free, and none can be expected to be correct in every case or close to it. A Result that reports no AI characteristics is not proof that a recording was made by a human, and a Result that reports AI characteristics is not proof that a recording was made by artificial intelligence. Results may differ between versions of the Service and over time, and the same recording may receive a different Result later.
Published figures describe test sets, not your recordings. Every accuracy, detection, error or similar rate that appears in any chart, table, report, page or document we publish, including figures such as 100% or 99.x%, is the score COSMIC obtained on the specific subset of data it was given, under the conditions and at the version stated. A perfect or near-perfect score on a subset does not mean that the Service detects every such file, or all files from any generator, platform or source, and it is not a promise, prediction, guarantee or warranty of how the Service will perform on any other recording. Files that have been modified or processed can be misclassified, and so can clean, untouched files.
Results are not legal, professional or expert advice or testimony. They do not determine whether any platform, distributor, label, contest, employer or institution will or should accept, reject, remove or pay for a recording, and we are not responsible for any decision any of them makes.
Where identical audio has previously been analysed by the same version of the Service, we may return the stored result instead of repeating the analysis.
5. Accounts and security
Some features require an account. You agree to provide an email address you control and to keep it current. You may not register with a disposable or temporary email address, or with an address from an email forwarding or alias service (such as SimpleLogin, Proton Pass aliases, addy.io, Firefox Relay or DuckDuckGo Email Protection); addresses at private email providers whose inbox you control are permitted. Sign-in uses single-use links sent to that address. You are responsible for safeguarding access to your email account, your devices and any session on them. You are responsible for all activity that occurs under your account and under any API key issued to it, whether or not authorised by you. Notify us promptly at [email protected] of any unauthorised use. We may refuse, suspend or close any account at our discretion, including where we reasonably suspect a breach of these Terms.
6. Plans, fees and billing
Paid plans and credit packs, their allowances and their prices are described at the point of purchase. Payments are processed by our payment processor, Square, under its own terms; we do not receive or store your full card details. You owe us no fees other than the plan and credit prices shown at the point of purchase. By purchasing a plan or credits you authorise us, through our payment processor, to charge those prices and any taxes or processing fees shown at checkout to your chosen payment method. Enterprise, partnership and custom arrangements are made under separate written agreements, which prevail over these Terms where they conflict.
Subscriptions renew automatically at the end of each billing period at the then-current price until cancelled. You may cancel at any time from your account page (Cancel plan); cancellation takes effect at the end of the current billing period, and you retain access until then. You may change plan from your account page; the new plan and its price start from your next billing date, and nothing is charged at the time of the change. Credits are paid for in advance. With a plan, one credit is used for each analysis charged after the plan's allowance is used up. Without a plan, credits are used before any free analyses, and free analyses remain available once your credits are used up; an analysis paid with credits is a paid analysis. An analysis with the localized scan counts as one analysis for each started five minutes of the recording, against the allowance and credits alike. Unused credits carry over from one period to the next and expire twelve (12) months after the date of purchase; the oldest credits are used first, and expired credits are removed without refund. Unused credits are also removed if you delete your account. We do not charge for API usage after the fact. Except where required by applicable law or stated in Section 16, all fees are non-refundable, including for partially used periods, unused allowances and analyses whose results you disagree with. We may change prices on reasonable advance notice; a change applies from your next billing period. You are responsible for all taxes associated with your purchases, other than taxes on our income.
New submissions and gift credits. Every new analysis uses normal allowance or credits, including the same file again and results served from our cache. A retry of the same submission does not spend usage again; viewing an existing saved result is free. Recordings under 20 seconds are rejected without a scan charge. We may give free credits ("gift credits"), for example through a link we share. Gift credits have no cash value and cannot be sold, transferred or refunded; they are used only on the website and only for recordings of up to 5 minutes, are used before your other credits and allowances, and expire on the date shown on your account page. Each gift link can be claimed once per person, and unused gift credits are removed if you delete your account.
An analysis that fails for reasons within our control is not counted against your allowance. New submissions count separately within the applicable period. A localized scan uses one unit per started five minutes. A plan's allowance counts usage in the 30 days before each analysis (a rolling 30-day window); it is not reset on your billing date. Unused allowance does not roll over, accumulate or carry into a later period unless the plan says otherwise. Separate processing protections cover short, invalid, cancelled or abandoned submissions, including work whose scan charge is refunded. Near that protection limit, submissions may need to retry while earlier work finishes.
Billing problems and payment disputes. If you have a problem with a charge, contact us first at [email protected]; we resolve billing issues, including refunds where appropriate, directly. If you or your card issuer dispute a payment, whether by an inquiry about the charge or by a chargeback, we may immediately suspend your account, its API keys and its access to the Service while the dispute is reviewed, and we may pause the renewal of your subscription during that time. While an account is suspended, its plan allowance and credits cannot be used, and credits continue to expire as described above. If the inquiry closes without a chargeback, we restore access, together with any unexpired credits and your subscription. If a chargeback is filed, we may permanently close your account: its subscription is cancelled, its remaining credits are forfeited, and its email address may not be used to register again. To respond to a dispute, we may give our payment processor and your card issuer records of your purchases and of your account's use of the Service.
Plan allowances and credits are separate from service capacity. Requests may be queued or temporarily limited during high demand or for abuse prevention. The daily and short-term limits are listed below. A request refused before an analysis is admitted does not use an analysis credit or recording allowance.
Usage limits. These limits apply in addition to a plan's allowance and are shared across an account's website sessions and API keys:
- Creator: 1,000 analyses per rolling 30 days, up to 100 in any 24 hours, 2 at once, 1 API key.
- Pro: 10,000 analyses per rolling 30 days, up to 1,000 in any 24 hours, 5 at once, 3 API keys.
- Business: 25,000 analyses per rolling 30 days, up to 2,500 in any 24 hours, 10 at once, 10 API keys.
- Credits without a plan: up to 500 analyses in any 24 hours, 3 at once, 1 API key.
- Free analyses: 1 per visitor and 3 per signed-in account in any 30 days, for recordings of up to 5 minutes, 1 at a time. The number of free analyses across the Service is also limited each day, so a free analysis may be unavailable when that limit is reached.
- Requests: up to 30 analysis requests an hour from the website, and up to 600 an hour per account, including its API keys.
We may change these limits as described in Section 3.
Length and size limits. The Service accepts recordings of up to 10 minutes, and files up to the size limits published with the Service or API documentation. Free analyses, made without a plan or credits, accept recordings of up to 5 minutes. These limits apply to uploads and links alike; for a link, the length is the length of the linked track. A recording or file over a limit is refused and not analysed, and the refusal uses no allowance or credit. A refusal under these limits is not a failure of the Service and does not entitle you to a refund or credit of any fee, except where applicable law or Section 16 requires otherwise. We may change these limits as described in Section 3.
7. API
API keys are confidential and personal to the account that created them. Limits are shared across all keys and website sessions on the same account; creating or rotating keys does not increase or reset them. You must honour retry instructions. Repeated rejected traffic may trigger a temporary account-wide restriction and security review. You must not share, publish or embed an API key in software distributed to others. You must comply with any rate limits, documentation and technical restrictions we publish. We may monitor API usage for security, billing and compliance, and may revoke or throttle keys at any time. You must not use the API to build a service that substantially replicates the Service or resells its results as a standalone detection product without our prior written consent.
8. Your content
"Your Content" means audio files, links and any other material you submit to the Service. As between you and us, you retain whatever rights you hold in Your Content. You grant us a worldwide, non-exclusive, royalty-free licence, for the period described in our Privacy Policy, to host, copy, transmit, decode, analyse and otherwise process Your Content, and to create and retain derived identifiers and results from it, solely to provide, secure, maintain and operate the Service, to enforce these Terms and to comply with law. We use audio you submit or ask us to retrieve only for your requested analysis. We delete it as described in our Privacy Policy and never use it for model training or subsequent testing.
You represent and warrant that: (a) you own Your Content or have all rights, licences, consents and permissions necessary to submit it and to grant the licence above; (b) where you submit a link, your doing so and our retrieving the linked audio for analysis on your behalf does not breach any agreement or terms of service binding on you, or any law; and (c) Your Content does not infringe, misappropriate or violate any third party's intellectual property, privacy, publicity or other rights, and is not unlawful. You are solely responsible for Your Content and the consequences of submitting it.
When you submit a link, you instruct us to retrieve the audio at that link on your behalf for the sole purpose of analysing it for you. We do not redistribute retrieved audio, and it is deleted as described in our Privacy Policy.
If you copy a link to a Result, anyone who has the link can see that Result until it expires, 24 hours after the analysis. You are responsible for who you give the link to. The shared view does not show the file name, file hash or metadata tags.
9. Acceptable use
You agree not to, and not to permit or assist anyone else to:
- use the Service in violation of any applicable law or regulation, or in a manner that infringes or violates the rights of others;
- submit content that you do not have the right to submit, or that is unlawful, malicious or contains malware;
- use any Result to harass, defame, libel, threaten, intimidate or publicly accuse any person or business, to compile or publish lists or rankings naming people or businesses as users of artificial intelligence, to make mass or automated reports, complaints or takedown requests, or to represent a Result as a fact, as evidence or as a definitive determination of how a recording was made or of who made it;
- circumvent, disable or interfere with any allowance, rate limit, bot check, access control, usage meter or other security or billing feature, including by creating multiple accounts, rotating network addresses or using automated means to obtain additional free analyses;
- reverse engineer, decompile, disassemble, extract, or attempt to derive the models, weights, thresholds, features, source code or underlying methods of the Service, except to the extent that this restriction is prohibited by applicable law;
- systematically query the Service, or use its outputs, to develop, train, test or improve methods for evading AI-audio detection, or to develop a competing product or service;
- scrape, crawl or harvest the Service or any data from it by automated means other than through the API in accordance with these Terms;
- probe, scan or test the vulnerability of the Service, breach any security or authentication measure, or attempt to access data not intended for you;
- impose an unreasonable or disproportionately large load on the Service, or interfere with or disrupt its integrity or performance;
- resell, sublicense, frame or mirror the Service except as expressly permitted by us in writing; or
- misrepresent your identity or affiliation, or falsely state or imply that COSMIC endorses you, your content or any conclusion you draw.
We may investigate and take any action we consider appropriate in response to a suspected violation, including removing content, suspending or terminating access, and cooperating with law enforcement.
10. Our intellectual property; third-party names
The Service, including its software, models, weights, thresholds, evaluation data, documentation, design, text, graphics, logos and the COSMIC name and marks, is owned by us or our licensors and is protected by intellectual property and other laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable licence to access and use the Service for its intended purpose. All rights not expressly granted are reserved. You may share individual Results you obtain, provided you do not alter them in a misleading way, you do not misrepresent their nature as described in Section 4, and you present them as probabilistic estimates. You share and use Results at your own risk.
All names of AI music generators, platforms, services, products, models, detectors, brands, companies, labels and artists that appear in the Service or in our materials, other than COSMIC and Angelware, are the property of their respective owners. They are used only to identify those owners and their products and to describe the tests we ran. We are not affiliated with, and are not sponsored, endorsed, approved or recognised by, any of them, and nothing in the Service states or implies otherwise. Any statement about a third party's product describes only how COSMIC performed on the data described, under the stated conditions, and is not a statement about how that product works or is used.
11. Feedback
We may use suggestions, ideas and reports you provide to troubleshoot, maintain and improve the Service without compensation to you. We handle feedback and any personal data it contains as described in our Privacy Policy, including its retention limits. Providing feedback does not grant us rights to any recording identified in it or change our commitments about submitted audio.
12. Third-party services
The Service relies on and may link to third-party services, including hosting, content delivery, bot protection, email delivery and payment processing providers, and the platforms from which linked audio is retrieved. Their services are governed by their own terms and policies. We do not control and are not responsible for third-party services, and the availability of any link source may change or end at any time.
13. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT ANY RESULT WILL BE ACCURATE, COMPLETE OR RELIABLE, THAT ANY DETECTION RATE OR OTHER PUBLISHED FIGURE WILL BE ACHIEVED ON ANY RECORDING, THAT RESULTS WILL BE FREE OF FALSE POSITIVES OR FALSE NEGATIVES, THAT ANY RESULT WILL AGREE WITH THAT OF ANY OTHER DETECTOR OR WITH THE RECORDS OF ANY GENERATOR OR PLATFORM, THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE OR ERROR-FREE, OR THAT DEFECTS WILL BE CORRECTED. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
14. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL COSMIC, ITS AFFILIATES, OR ITS OR THEIR OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AGENTS, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, REPUTATION OR DATA, OR COSTS OF SUBSTITUTE SERVICES, ARISING OUT OF OR RELATING TO THE SERVICE, ANY RESULT, ANY DECISION MADE OR ACTION TAKEN IN RELIANCE ON A RESULT, OR THESE TERMS, WHETHER BASED ON CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, WE ARE NOT RESPONSIBLE OR LIABLE FOR ANY USE OF A RESULT BY YOU OR BY ANYONE YOU SHARE IT WITH OR WHO OTHERWISE OBTAINS IT, INCLUDING ANY CLAIM OF DEFAMATION, HARASSMENT, WRONGFUL ACCUSATION, LOST CONTRACT, PAYMENT, ACCOUNT OR PLACEMENT, OR TAKEDOWN ARISING FROM IT.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED ONE US DOLLAR (US$1).
These limitations apply even if a remedy fails of its essential purpose, and they form an essential basis of the bargain between you and us. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, such as liability for fraud or, where applicable, for death or personal injury caused by negligence.
15. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify and hold harmless COSMIC and its affiliates, owners, officers, employees, contractors and agents from and against any claims, liabilities, damages, losses, judgments, fines, penalties, costs and expenses, including reasonable legal fees, arising out of or relating to: (a) Your Content; (b) your use or misuse of the Service or any result, including any decision made or action taken in reliance on a result; (c) your breach of these Terms; (d) your violation of any law or the rights of any third party; (e) your publication, sharing or presentation of a Result, including any third-party claim of defamation, harassment or misrepresentation; or (f) any subpoena, request or other legal process directed at us because of your use of the Service, including the reasonable cost of responding to it (we are not an expert witness and do not agree to act as one). We may assume the exclusive defence and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defence.
16. Suspension and termination
You may stop using the Service at any time and may delete your account from the account page. Deleting your account ends access at once and cancels any subscription so that it does not renew; the rest of the billing period already paid for is not refunded. We may, at our sole discretion and with or without notice or stated reason, suspend, restrict or terminate any account, API key, subscription or other access to all or part of the Service. Without limiting that discretion, we may do so where we suspect a breach of these Terms, fraud, abuse, a disputed payment, the creation of accounts in bulk or by automated means, the use of a disposable email address or an email forwarding or alias service, or a risk to the Service, to us or to others, or where required by law. A suspended account cannot sign in or use its API keys, and its email address cannot be used to register again while the suspension lasts.
If we terminate a paid plan or remove unused credits for a reason other than your breach of these Terms or of the law, we will refund the unused prepaid portion: the remainder of the current billing period and any unused credits. No refund is due where we suspend or terminate access because of your breach of these Terms or of the law, because of fraud or abuse, or because a chargeback was filed for a payment made for the account (see Section 6). On termination, your right to use the Service ends immediately, and we may delete data associated with your account as described in our Privacy Policy. Sections 4, 8 (as to your warranties), 9 through 15, 17 and 18, and any accrued payment obligations, survive termination.
17. Dispute resolution; binding arbitration; class action waiver
17.1 Informal resolution. Before starting any formal proceeding, you and we each agree to try to resolve any dispute informally by sending a written notice describing the dispute and the relief sought (to us at [email protected]). If the dispute is not resolved within sixty (60) days of receipt of the notice, either party may proceed as set out below.
17.2 Agreement to arbitrate. Except as provided in Section 17.4, any dispute, claim or controversy arising out of or relating to these Terms or the Service, including their formation, interpretation, enforceability or scope, will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules (or, where you use the Service for business purposes, its Commercial Arbitration Rules) then in effect. The Federal Arbitration Act governs the interpretation and enforcement of this Section 17. The arbitrator may award the same individual relief a court could award, and the arbitrator's award may be entered in any court of competent jurisdiction.
17.3 Class action waiver. YOU AND WE EACH AGREE THAT ANY PROCEEDING WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate the claims of more than one person or preside over any form of class or representative proceeding. If this class action waiver is found unenforceable as to any claim, that claim must be severed and heard in court, and the remainder of this Section 17 continues to apply.
17.4 Exceptions. Either party may bring an individual action in small claims court for a dispute within that court's jurisdiction, and either party may seek injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation or violation of intellectual property rights or of Section 9.
17.5 Jury trial waiver. To the extent any dispute proceeds in court rather than arbitration, YOU AND WE EACH WAIVE ANY RIGHT TO A JURY TRIAL.
17.6 Opt-out. You may opt out of this agreement to arbitrate by emailing [email protected] within thirty (30) days after you first accept these Terms, stating your name, the email address associated with your use of the Service, and that you opt out of arbitration. Opting out does not affect any other part of these Terms.
17.7 Mandatory consumer law. If you are a consumer resident in a jurisdiction whose mandatory law does not permit pre-dispute arbitration agreements or class action waivers, or grants you the right to bring proceedings in the courts of your place of residence, Sections 17.2 to 17.6 apply only to the extent permitted by that law, and nothing in these Terms deprives you of the protection of mandatory provisions of the law of your country of residence.
17.8 Time limit; remote hearings. To the extent permitted by applicable law, any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after it arose, or it is permanently barred. Arbitration hearings may be conducted by video conference or on written submissions.
18. Governing law and venue
These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Delaware, United States, and applicable US federal law, without regard to conflict-of-laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Subject to Section 17, any dispute not subject to arbitration may be brought in a court of competent jurisdiction. Nothing in this Section limits the mandatory consumer protections of the country or state where you live (see Section 17.7).
19. General
Changes to these Terms. We may modify these Terms from time to time. If a change is material, we will provide reasonable notice, for example by posting the updated Terms with a new effective date or by email to account holders. Changes take effect on the stated effective date and do not apply retroactively. Your continued use of the Service after that date constitutes acceptance of the updated Terms; if you do not agree, you must stop using the Service.
Entire agreement. These Terms, together with the Privacy Policy and any terms presented at the point of purchase, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements and understandings on that subject.
Severability and waiver. If any provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permissible and the remaining provisions remain in full force and effect. Our failure to enforce any right or provision is not a waiver of it.
Assignment. You may not assign or transfer these Terms or any rights under them without our prior written consent. We may assign these Terms without restriction, including in connection with a merger, acquisition, reorganisation or sale of assets.
Force majeure. We are not liable for any failure or delay in performance caused by events beyond our reasonable control, including failures of third-party services, networks or link sources.
Notices. We may give you notice by email to the address associated with your account or by posting on the Service. You may give us notice at the contact details below.
No third-party beneficiaries; relationship. These Terms do not confer rights on any third party, and nothing in them creates a partnership, joint venture, employment or agency relationship.
Headings and interpretation. Headings are for convenience only. "Including" means "including without limitation".
